ADDIS ABABA (AFP) — The US embassy in Addis Ababa on Wednesday voiced concern over the fate of an opposition leader who was jailed after her pardon from a life sentence was revoked.
Birtukan Midekssa, head of the Unity for Democracy Justice party, irked the regime when she reportedly claimed during a recent visit to Europe that she had never voiced remorse or acknowledged any mistake to obtain her pardon in 2007.
“The United States is concerned about the government of Ethiopia’s arrest of Unity for Democracy and Justice Party leader Birtukan Midekssa,” the embassy’s information officer Darragh Paradiso told AFP.
“We are particularly concerned by reports that Birtukan’s pardon has been revoked and she has begun a life sentence in prison.”
The 35-year-old woman, who was detained with dozens of opposition figures and supporters in the aftermath of disputed 2005 elections, was last week given a three-day ultimatum by the authorities to confirm or deny the reports.
The justice ministry announced on Tuesday that she has resumed serving her life term.
The United States, a staunch Ethiopian ally and the country’s top aid contributor, called for more political freedom.
“A vibrant opposition, independent media, and a robust civil society are essential elements of any democracy,” Paradiso said.
“The United States looks to the government of Ethiopia to provide the political space necessary for them to function. Steps that appear to criminalise dissent impede progress on democratisation,” he added.
Birtukan’s party made its most spectacular electoral gains ever in the 2005 polls and cried foul over reported fraud, claiming it was robbed of victory by Prime Minister Meles Zenawi’s ruling party.
The ensuing unrest left close to 200 civilians dead and drew international condemnation.

What a bizarre world! The US embassy called for the release of UDJ’s leader before the plonking compatriots–Yacob, Hailu, Mesfin, Gizachew et al..— voiced anything which any decent person would do for anyone whom she knows only through hearsay. Oh! poor ethiopians! are you expecting such plonkers to lead you to freedom and liberty? These are collections of cruel and coward people. Some might have thought the moment as the most opportune to become chair person—you know who I mean!–and others want to slip off the stage quietly. All decent Ethiopians should not wait for leadership from these plonkers and bunch of opportunists. Let’s all in the diaspora organise and unite independently to fight for the immediate release of Bertukan, irrespective of our secondary political differences.

In case you missed UDJ’s press release it is posted somewhere in this forum. Before making idiotic remarcs, I suggest that you get the facts straight first. This is not a single person patry. So the top leaders will not come out for one liner notes to satisfy your ego. FYI- Mesfin - if you’re reffering to the Prof…he was there - along side with Birtukan and got beaten up because “he” stood up and tried to stop the drama. But then again you are in the US in a comfy situation. If you’re really concerned about it, I dare you to return to Ethiopia- carry a big sign that says “FREE BIRTUKAN” and we’ll see how long you’ll last fool!

The Diaspora should avoid going to Ethiopia as there is no justice at all. You could be arrested anytime for no reason and taken to jail.

I don’t understand how the importance of demanding to voice strong condemnation from UDJ’s leadership against Woyane for the unlawful arrest of Bertukan can be lost on you, if you really are concerned about the interest of the movement rather than cloistered in a stunt feudal mentality of worshipping individuals. What simpler issue than this are you expecting in the Ethiopian situation for UDJ’s leadership to stand up together? Have you read the views expressed by Beyene, Merera and Bulcha? They have stood more steadfastly in solidarity with Bertukan than her own so-called compatriots in UDJ leadership did. To say the least, this is shameful. Nonetheless, I believe that the ordinary members of the UDJ movement–save you three and your likes– are more on the same wave length with these other personalities’ statements (Beyene, Merera, Bulcha) than that of the crap of mumbo jumboes posted yesterday by UDJ’s leadership.

የኦፌዴን ሊቀመንበር አቶ ቡልቻ ደመቅሳ በበኩላቸው የወ/ት ብርቱካንን መታሰር “ማንም የኢትዮጵያ ዜጋ ሊያወግዘው የሚገባው ተግባር ነው” ሲሉ ተችተዋል፡፡ እንደ አቶ ቡልቻ ገለፃ በአንድ ቅጣት አንድ ሰው ሁለት ጊዜ ሊታሰር የማይችል በመሆኑ የወ/ት ብርቱካን ድጋሚ መታሰር አግባብ አይደለም፡፡ “ውሸት ተናገርሽ ብሎ ማሰር ሕጋዊም ሰብዓዊም እርምጃ አይመስለኝም” ብለዋል፡፡
የወ/ት ብርቱካን ይቅርታ መነሳት ከሕግ አንጻር
የአንድነት ለዴሞክሲና ለፍትሕ ሊቀመንበር ወ/ት ብርቱካን ሚደቅሳ ሰኞ ታህሳስ 20 ነቀን 2001 በድንገት ከመንገድ ላይ በፖሊስ ከታሰሩ በኋላ ማምሻውን የመንግሥት መገናኛ ብዙሃን የፍትሕ ሚኒስቴር ሰጠው የተባለው መግለጫ ወ/ት ብርቱካን የታሠሩትና የተሰጣቸው ይቅርታ የተሠረዘባቸው “ይቅርታ አልጠየቀኩም” በሚል በውጪ ሚዲያዎች መግለጫ በመስጠታቸው መሆኑን ይገልፃል፡፡ ይህን እንዲያስተባብሉ በተደጋጋሚ ተነግሯቸው ይቅርታ አልጠየኩም በሚለው አሉታዊ መግለጫቸው በመፅናታቸው የተደረገላቸው ይቅርታ በገዛ ፈቃዳቸው የማንሳት ድርጊት በመሆኑ የይቅርታውን ሁኔታ ጥሰዋል፡፡ በዚህም በይቅርታ ሥነ ሥርዓት አዋጅ አንቀፅ 16 ንዑስ አንቀፅ 4 መሰረት የሕግ ሒደቱን ተከትሎ የተደረገላቸው ይቅርታ በመነሳቱ ከይቅርታው በፊት በጥፋታቸው ፍ/ቤት የወሰነባቸው የዕድሜ ልክ ጽኑ እሥራት እንዲፈፅሙ ለማድረግ በቁጥጥር ስር ውለው ወደማረሚያ ቤት እንዲገቡ መደረጉን ዘግበዋል፡፡
አንድ ስማቸውን መግለፅ ያልፈለጉ የሕግ ባለሙያ ለሪፖርተር ጋዜጣ እንደተናገሩት ፍትሕ ሚኒስቴር ስለወ/ት ብርቱካን የይቅርታ አነሳስ ሰጠው የተባለውና በመንግሥት መገናኛ ብዙሃን የተላለፈው መግለጫ ይቅርታው በማንና እንዴት እንደተነሳ አይገልጽም፡፡ በይቅርታ ሥነ ሥርዓት አዋጅ ቁጥር 395/1996 መሰረት ፍትሕ ሚኒስቴር ስላለው ሥልጣንና ተግባር በግልፅ የተቀመጠና የሚታወቅ ነገር የለም፡፡ ምናልባት የይቅርታ ቦርዱ በፍትህ ሚኒስቴር ስር ስላለ፣ የቦርዱ ሰብሳቢም የፍትሕ ሚኒስትሩ ስለሆኑ ሁለቱ ተቋማት አንድ ናቸው በሚል አስተሳሰብ ተወስዶ ከሆነ ይህም ግልፅ መሆን እንዳለበት ተናግረዋል፡፡
በአዋጁ አንቀፅ 4 ንዑስ አንቀፅ 3 ላይ በግልጽ እንደተደነገገው ይቅርታ የተደረገላቸው ሰዎች ቅድመ ሁኔታ አላሟሉም ወይም ጥሰዋል የሚል ክስ ሲቀርብባቸው ጉዳዩን መርምሮ ለፕሬዚዳንቱ የውሳኔ ኃሳብ የሚያቀርበው የይቅርታ ቦርድ ነው፡፡ በአዋጅ አንቀጽ 10 ንዑስ አንቀጽ 2 መሰረት ከቦርዱ የቀረበውን የውሳኔ ኃሳብ መሰረት በማድረግ ይቅርታውን የመሰረዝ ሥልጣን ያላቸው የአገሪቱ ፕሬዚዳንት ናቸው፡፡ ፍትህ ሚኒስቴር በሰጠው መግለጫ እነዚህን ሁኔታዎች ስለመሟላታቸው ምንም ያለው ነገር ባለመኖሩ ሕግ አስከባሪው ሕግ አከብራለሁ ሲል ራሱን ሕግ አለመጣሱን የማረጋገጥ ኃላፊነቱን አለመወጣቱን የሚያሳይ ይመስላል ብለዋል፡፡
የሕግ ባለሙያው አያይዘው በአዋጁ አንቀፅ 17 መሠረት ይቅርታ ሲሰረዝ ምክንያቱ ለባለ ጉዳዩ በግልጽ ቋንቋ በፅሁፍ ሊደርሰውና ባለጉዳዩም በ20 ቀናት ውስጥ ምላሽ የመስጠት መብት አለው፡፡ ይህ በይቅርታ ቦርዱ በኩል ተሟልቷል ወይ? ሲሉ ይጠይቃሉ፡፡
የአንድነት ለዴሞክራሲና ለፍትህ ፓርቲ (አንድነት) ወ/ት ብርቱካን ከዚሁ ጉዳይ ጋር በተያያዘ ለመጀመሪያ ጊዜ ታህሳስ 1 ቀን 2001 ዓ.ም በፌዴራል ፖሊስ ኮሚሽን ጥሪ እንደደረሳቸው፣ የአጠራሩ ሁኔታ ግን ሕግን ያልተከተለ ወይም የፖሊስ መጥሪያ ያልደረሳቸው መሆኑን በወቅቱ ባወጣው መግለጫ መግለፁ ይታወሳል፡፡
በቀጣይም ወ/ት ብርቱካን ታህሳስ 13 ቀን ቀን 2001 ዓ.ም ከቀኑ በ11፡30 ሰዓት እስከ 12፡00 ሰዓት ባለው ጊዜ ውስጥ ሁለት የደንብ ልብስ የለበሱ ፖሊሶች ወ/ት ብርቱካን መኖሪያ ቤት ቢሄዱም ወ/ት ብርቱካን በሰዓቱ ባለመኖራቸው ፌዴራል ፖሊስ ኮሚሽነር ጽ/ቤት እንደሚፈለጉ የቃል መልዕክት ትተው መሄዳቸውን ያስታውሳል፡፡ በማግስቱ ታህሳስ 14 ቀን 2001 ከጠዋቱ በ12፡00 ሰዓት የደንብ ልብሰ የለበሱ ፖሊሶችና አንድ ሲቪል የለበሰ ግለሰብ ወደመኖሪያ ቤታቸው በመሄድና ከተኙበት በመቀስቀስ ከቀኑ በ5፡00 ሰዓት ፌዴራል ፖሊስ ኮሚሽን ፅ/ቤት እንዲቀርቡ በቃል መልዕክት ነገሩ፡፡ ለምን ጉዳይ ነው?” ተብለው ሲጠየቁ የተላኩት ሰዎች ስለጉዳዩ እንደማያውቁ ተናገሩ፡፡
ሆኖም ወ/ት ብርቱካን የደረሳቸው የቃል ጥሪ በመሆኑና የፍ/ቤት ወይም የፖሊስ መጥሪያ ያልደረሳቸው በመሆኑ በተጠሩበት ሰዓት አለመሄዳቸውን ገል”ል፡፡ በዚሁ እለት ከቀኑ 8፡30 ሰዓት ገደማ ሁለት የሲቪል ልብስ የለበሱ ሰዎች አንድነት ጽ/ቤት ድረስ መጥተው የመጥሪያ ወረቀት በማቅረብ ወ/ት ብርቱካንን ይዘዋቸው ሄደዋል፡፡ ፖሊስ ካነጋገራቸውም በኋላ የተሰጣቸውን መጥሪያ እንዲመልሱ ተጠይቀው ለመጠራታቸው ሕጋዊ ማስረጃ ስለሆነ አልመልስም ብለዋል፡፡ ሆኖም ወደቢሯቸው እንዲመልሷቸው የታዘዙት ፖሊሶች ወደታዘዙበት በመውሰድ ፈንታ ወደማዕከላዊ ወንጀል ምርመራ አስገድዶ በመውሰድ የጥሪ ወረቀቱን እንዲመልሱ ቢያስገድዱም ወ/ሪት ብርቱካን በአቋማቸው በመፅናታቸው የጥሪ ወረቀቱን ይዘው መመለሳቸውን አንድነት ፓርቲ ታህሳስ 14 ቀን 2001 ዓ.ም ባወጣው መግለጫ አስታውቋል፡፡

What does it mean? “the United states calls for more political freedom, astaunch Ethiopian ally and the country’s top contributer, called for more political freedom” as stipulated by AFP. Then he went on with the statement from paradiso, ” A vibrant opposition…….. are essential elements of any democracy” then read carefulluly the following quote and read the statement by AFP ascribing the leadership of CUDP to UDJP, or the torch bearer for the peaceful struggle. That absurd and lopsided, when there are other oppostion parties engaged in a genuine peaceful strugle than UDJP.
As far as more political freedom is concerened ther has been no political freedom since 1991 for the opposition parties and the political space is getting ever more narrower for the hardlineres than for the moderates.The call for more freedom, more political space does not cut it, since freedom is an either /or situation i.e either you have it or you do not have it. It is not quantitative. It is qualitative event.

The economic growth as you know has also brought inflation since the people living is improving as the US and Europe, living becomes expensive. The political situation in Ethiopia is much worse than in Zimbabwe. I wonder why the “Beacons of Democracy” in the west use Double Standards when it comes to the issue of Ethiopia! ..Please remember that it is The Ethiopian People who is an Ally on the war against terrorism; not the ethnic minority government led by Meles. The meaning of Democracy is being presented by the present regime as the establishment of Marxist Leninist type of Revolutionary Democracy in line with the interest of Only TPLF. If the west keeps on supporting this pro-communist policy of Meles, True Democracy in Ethiopia will never show up…..instead lawlessness and dictatorship prevails.
It is high time for the west, specially US under the new leadership, to take the initiative and say -Enough is Enough!

Dec 30 2008. The Punishment of Virtue Birtukan Mideksa - a brave human being who stood up for her rights and for the rights of all Ethiopians - has been arrested. Five or six TPLF goons roughly grabbed her and shoved her into a car. Mesfin Wolde Mariam - a 78 year old man - was bashed in the head with a gun for asking the TPLF operatives not to mistreat Birtukan. Three years earlier, these same goons executed the wife of an oppposition leader while he was being arrested. This is TPLF.

ዔritrea needed steady hands at the till to weather Meles’ coordinated and multi-thronged “no-war-no-peace” and its own son – Issaias has just provided her with able hand to smash and conquer the evil strategy . After the open support of the American administration for Ethiopia’s illegal occupation of Badme and its environs, Eritrea faced with two options i.e., either cave in to weyanes’ demand to sit down and accept the status-qo or fight the weyanes and its supporters with every ounce of Energy it has and it just did that and the signs of victory are now starting to surface! The Melesian theory to strungulate Eritrea economically was centered on these few strategies:
1. An economic blockade - not to let any goods from Ethiopia to Eritrea. After, the war started Eritreans faced w ith zero hours. For years, Eritreans whose incomes were based on small scale business were not pressed to engage in Agricultural activities. Everything ranging from eggs, Teff, Berbere, fruits and so on. Eritrea faced this “zero-hour” by engaging in intensive irrigation activities and now, Eritrea, thanks to the visionary policies, the nation is well positioned not only to feed itself but export surplus productions. It has also managed to attract Mining companies that explored Eritrea’s virgin gold resources. By 2009, Eritrea will be major gold exporting country with potential earning of hundreds of millions dollars that will play vital role to its economy. The Ethiopian blockade was a blessing in disguise! It enabled the industrious Eritreans to use their internal resources and be the kings of their destiny. Speaking changing challenges into opportunities!!
2. A diplomatic isolation: The Meles regime worked tirelessly to forge an alliance among Eritrea’s immediate neighbors to diplomatically isolate and frustrate Eritrea. After few years of fanfare and photo apps, the Yemen-Ethiopia and Sudan alliance faltered. Eritrea has successfully brought Sudan into its fold and its diplomatic relations with Egypt, Libya, Chad, and the Arab world is progressing well. And, now the new strategic alliance with Iran is getting much attention and Eritrea is well prepared to take advantage of this spotlight because for first time, Eritrea’s ne strategic alliance will elucidate Eritrea’s strategic importance and the region and also make the American administration to re-think its policy of shoving Eritrea aside will not bring any dividends to uncle Sam’s national interest. Thanks to those strategic alliances, Eritrean army is no w equipped with MIGS, SU-27s, SAM missiles, Surface to Air missiles, sophisticated tanks, short range missile armed war ships and newly introduced strategic missiles with more than few hundred miles range.
3. Place Eritrea in prolonged period of no-peace-no-war situation: Apparently the no-war-no peace is a daunting challenge for Eritrea. Let alone for tiny nation like Eritrea, even for nation’s with much stronger economy to keep an army 300k army on alert for more than a decade is very difficult. However, used this opportunity, to launch a marshal plan of it’s on and use the army to built dams, roads, and work in extensive irrigation activities. This marshal plan named as “Weferi –Warsay Yekealo” was a successful experiment and it will be in the history books to teach African countries how to liberate themselves from being carrier-beggars-for handouts!
4. Meles’ support of Eritrea’s opposition groups to topple President Issaias Afeworki has been a zero-sum calculation. On the contrary, Eritrea has succesfuly trained, armed Ethiopian opposition groups to successfully wage an armed struggle against the Melees regime. The ONLF is now a force to be reckoned with. Meles has launched a repeated coordinated mechanized offensive against ONLF fighters and terribly failed to wipe out the freedom fighters. There is one option left for Meles when it comes to Ogadenia and that is to sit down and cave in to the demands of the freedom fighters!! Other armed groups like OLF, TPDM, EPPF, Gambella Liberation Front, Biashangul Liberation Front, Southern Ethiopia Liberation Front, Sidama Liberation Front are posing credible threat to Meles regimes existence. Adding to the internal opposition, Eritrea skillfully drawn Meles into the Somalia quagmire and now Somalia is turning into becoming the Vietnam for Meles regime and Somalia will also cause the downfall of the Meles regime. What Meles has achieved in Somalia? The answer is nothing; on the contrary it has sown deep rooted hatred of the Somalia people toward Ethiopia. This will trigger Somalia’s to elevate their support Ethiopian opposition groups like ONLF, OLF and others. President Issaias Afeworki has envisioned this quagmire perfectly, now the 3 million Eritreans will face the Meles regime along the ONLF, OLF, EPPF, TPDM, Sidama Liberation front, Gambella Liberation Front and others.
To sum up, the Meles strategy has terribly failed and now he is literally begging some European nations to help him settle the border raw with Eritrea. In the last ten years, President Issaias Afeworki steady hand in regard to the border issue has made the act ecliptically. As we all remember, when the verdict was rendered, the unashamed Ethiopian foreign minister told Ethiopians in broad day light that Badme as rewarded to Ethiopia and poor Weyane followers celebrated this fabricated victory news by going out in mass in Meskel square to only reminded that they ere followed by their foreign minister. The fiasco will never end there. Then Meles wrote a letter to UNSC council that the verdict as terminally flawed and Ethiopia will never accept it and he came up with his five point plan. And, then swallowed his own words and declared that he accepted the verdict in principle. The drama never ends there now he is telling the international community…forget what I said before now I have accepted the verdict unconditionally….The border commission knowing fully well Meles’ unwillingness to settle the border dispute with Eritrea in a legal manner issued a precise virtual demarcation and warped up its duty and existence. Now, Meles is calling the virtual demarcation as legal “none-sense”. If the past pattern is any indication, Issaias ’s steady hand will once force Meles to accept the virtual demarcation and ask in return to stop supporting Ethiopian opposition groups but by then it will be too late. All in all, the tiny nation of three million people has successfully kept the Meles regime at bay thanks to the indomitable and determined people! Now I know the greatest African General –Sebhat Ephrem of Eritrea- When he said, “you don’t built a building and not know how to bring it down”. Yes indeed Shabia built the rag tag TPLF army from bottom up and it knows how to dismantle it and it is well in its way!! What a people and what a country!!!!
